The defendant faces a five-count information arising from the death of Clair F. Hoyles m, who was two years old at the time of his death. Young Clair was the son of the defendant’s paramour and co-defendant, Tamie L. Gates. The offenses with which Mr. Derk is charged are: murder of the first degree, 18 Pa.C.S. §2501(a); murder of the third degree, 18 Pa.C.S. §2502(c); aggravated assault, 18 Pa.C.S. §2702(a)(l); endangering welfare of children, 18 Pa.C.S. §4304; and recklessly endangering another person, 18Pa.C.S. §2705.
