PAYNE, District Judge.
Having stipulated the relevant facts, the parties have submitted this action for decision on cross-motions for summary judgment. The dispositive issue is whether provisions of the Virginia’s Workers’ Compensation statutes which require employers to provide security for the payment of occupational injury and illness benefits are preempted by the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001, et seq.
