Johnson, President :

This is an action of debt brought in the Circuit Court of Monongalia county in May, 1883. The defendant appeared and filed a general demurrer to the declaration, which was overruled; and defendant pleaded payment. The issue was on the 19th day of October, 1883, tried by a jury and a yeiv diet rendered on the 23d day of October for the plaintiff for the sum of $778.31. Thereupon, as the record shows, judgment was suspended. On the 26th day of the same month the court entered judgment on the verdict.
