GARLAND, District Judge.

This is an action of ejectment brought by plaintiff against defendants to recover possession of lots 3 and 4, and the S. E. ¾ of the S. W. | of section 10, all in township 104, range 71 W., Brule county, S. D.' The case was tried at the present term of the court, and a verdict directed for defendants. On the trial the plaintiff, to establish his title to the demanded premises, offered in evidence a patent from the United States dated July 26, 1899, conveying lots Nos, 3 and 4, and the S. E. ¼ of the S. W. ¼ of section 10, and lot No. 1 of section 15, in township 104…
