On December 14, 1989, the Department of Social Services (department), filed a care and protection petition pursuant to G. L. c. 119, § 24 (1992 ed.), seeking custody of Rebecca and Ruth,2 twins born to Helen (mother) on April 15, 1981. The department was granted temporary custody of the twins on that day. On December 7, 1990, after a trial, a judge of the District Court adjudicated the children in need of care and protection and awarded custody to the department.
