MEMORANDUM

TENNEY, District Judge.

The instant case is before this Court on the motion of defendant (hereinafter “Humble”) for summary judgment pursuant to Fed.R.Civ.P. 56. For the reasons set out infra, the motion is granted in part and continued in part.

The case sub judice is the fourth in a series of arbitration, district court and appellate court proceedings growing out of a labor dispute between Humble and plaintiff (hereinafter the “Union”).
