The action is for partition of real estate devised by Samuel Dors worthy. There was no dispute as to the facts, and judgment followed the prayer of the complaint. The exception is to so much of it as depends upon the construction given by the trial court to these words of the testator: “Fifth. Immediately after my youngest child shall become of age, I give and devise the whole of my estate, real and personal, to my said children, or such of them as may be at that time living, to have and to hold to them, as tenants in common, during their respective lives.
