Defendant-Appellant Michael Jerome Brown was convicted by a jury of a single count of possession of a firearm after having been convicted of a crime punishable by a term of imprisonment exceeding one year in violation of 18 U.S.C. § 922(g)(1). He was sentenced to a term of imprisonment of 120 months followed by three years of supervised release, and ordered to pay a $1,000 fíne.

On appeal, Mr. Brown challenges his conviction on the basis that § 922(g)(1) is unconstitutional as applied in this case because the government was not required to prove the gun…
