The defendant, Keith Niemic, was convicted of murder in the first degree by reason of extreme atrocity or cruelty. At his trial, Niemic admitted that he stabbed the victim. His defense was self-defense. He also claimed that his conduct did not cause the victim’s death. Represented by new counsel on appeal, Niemic asserts errors in (1) the judge’s instructions; (2) the admission of certain evidence; (3) his trial counsel’s performance, which he claims was ineffective; and (4) the prosecutor’s presentation to the grand jury.
