In June, 2001, the defendant, Raymond Colon, was found guilty of murder in the first degree on the theory of deliberate premeditation.1 He also was found guilty of unlawful possession of a firearm, G. L. c. 269, § 10 (a) and (d), and unlawful possession of a firearm or ammunition without an identification card, G. L. c. 269, § 10 (h).2 The defendant appealed.
