Contractors’ Labor Pool (CLP) challenges a Board determination that CLP’s policy of refusing to hire applicants whose recent wages were 30% higher or lower than its starting wages was discriminatory within the meaning of § 8(a)(3) of the National Labor Relations Act. Also challenged is the Board’s conclusion that CLP discriminated against several paid union organizers in assignment because, according to petitioner, they were not its “employees” or, alternatively, because of a “disabling conflict,”…
