This appeal involves the intervenor in a suit for damages based on breach of contract in which judgment was awarded to the original plaintiff against the defendant.

On or about January 25, 1982, Athena Pipeline, Inc., a Georgia corporation, entered into a contract with Owens-Illinois Development Corporation and agreed to furnish all labor, materials, equipment and supplies to construct a complete water treatment and distribution system in Owens-Illinois Development Corporation’s Scenic Shores subdivision (Tract 29), in Hancock County, Georgia.
