Petitioner (hereinafter the father) and respondent (hereinafter the mother) married in 1995 and have three children (born in 1994, 1998 and 2000). In 2001, the parties were divorced and the mother was awarded custody of the children. However, in December 2008, an order was issued on consent of the parties awarding the father custody of the oldest child, while the two younger children remained with their mother.
