Appeal from an order of the Family Court of Broome County (Pines, J.), entered October 9, 2013, which dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.

Petitioner (hereinafter the father) and respondent (hereinafter the mother) are the parents of a son (born in 2008). In April 2010, they consented to an order providing for joint legal custody of the child, with the mother having primary physical custody and the father receiving parenting time on alternate weekends and as otherwise agreed to by the parties.
