MEMORANDUM OPINION AND ORDER

KANE, District Judge.

This is an action by the Secretary of Labor (hereinafter “secretary”), against the defendants, Gingerbread House, Inc., and its president, James Stone and program director, Patricia Stone, to enjoin the defendants from violating certain provisions of the Fair Labor Standards Act of 1938 (as amended, 29 U.S.C. § 201 et seq.) and to recover unpaid overtime compensation owed to the defendants’ employees. Specifically, the secretary charges the defendants with failing to keep, make and preserve wage and hour records in accordance with 29 U.S.C. §§…
