Appeal from a judgment of the Superior Court of Sacramento County, and from an order refusing a new trial. The facts are stated in the opinion.

Action to recover $1,807.40 for lumber, building material, and piles, sold and delivered by plaintiff to defendant.

Plaintiff had a verdict for $1,087.90, upon which judgment was entered.

The appeal is taken from the judgment and from an order denying a motion for new trial.

Defendant interposed a demurrer to the complaint, which was overruled.

The demurrer was properly overruled. The pleading after averring the indebtedness of defendant in the sum of $1,578.97, on account of certain lumber, building material, etc., sold and delivered to defendant by plaintiff between October, 1880, and…
