City Investment Corporation (hereafter owner) appeals from an order and judgment in injunction in favor of the City and County of San Francisco (hereafter City) decreeing the demolition of a building as a statutory and common law nuisance. The owner contends that: 1) the City was estopped from prosecuting the instant action by the parties’ 1966 agreement; 2) the court erred in the admission of certain documentary evidence concerning the intent of the agreement, and other evidence obtained by an unlawful search; and 3) the court erroneously applied the City’s Municipal Code to…
