Action by the receiver of the insolvent Allemannia Bank to recover an assessment ordered by the district court of Ramsey county from a legatee holding a distributive share of the estate of a stockholder of the bank. The cause was tried to the court. Findings of fact were duly returned, upon which the court held in favor of plaintiff, and ordered judgment against defendant, who thereafter moved to vacate the order therefor, and for judgment for defendant notwithstanding the findings, which was denied.
