Affirming.
A. O. Middleton sned his former wife, Mary K. Middleton, now Mary K. Chambers, to recover a house and lot in Lexington, Ky., and a one-third interest in 1,600 *509acres of land in Mississippi, and other property which he claims that she received from him "by virtue of the marriage relation. The parties were divorced from each other by a judgment of the Fayette circuit court in November, 1919, without an order of restitution being made.
