In this action by Genevieve Langhammer to recover $10,250 damages from the City of Mexico a jury found the issue of negligent injury in favor of the plaintiff and fixed her damages at $4,000. The trial court overruled the city’s motions for judgment but sustained its motion for a new trial on the specified ground that the court had erred in giving plaintiff’s instruction three as to the measure of damages.
