Plaintiff, Drovers Bank of Chicago, acting as trustee under a trust agreement known as trust No. 82158, filed a complaint against defendants, the Village of Hinsdale (Village) and its board of trustees, alleging that the Village’s denial of plaintiff’s development plan was arbitrary and capricious and violated plaintiff’s fourteenth amendment equal protection and substantive due process rights. The trial court dismissed the last two counts of plaintiff’s third amended complaint which sought damages pursuant to section 1983 of the Civil Rights Act (42 U.S.C. §1983 (1988)). Plaintiff timely…
