The American Historic Racing Motorcycle Association Ltd. (“AHRMA”) brings this trademark infringement and dilution action against Team Obsolete Promotions (“Team Obsolete”) alleging that Team Obsolete unlawfully used AHRMA’s registered trademark, BEARS. Team Obsolete counterclaims for declaratory judgment. AHRMA presently moves for summary judgment (Doc. No. 38) on all of the claims, and Team Obsolete argues in opposition that BEARS is a descriptive mark not entitled to trademark protection and, alternatively, that AHRMA…
