Appeal by the defendant, Charles W. Pratt, from a judgment of the Supreme Court in favor of the plaintiff, entered in the "office of the clerk of the county of Oneida on the 28th day of June, 1901, upon the report of a referee.

Hiscock, J.:

This action was brought to recover, with interest, a balance of $587.37, claimed to be due from defendant to plaintiff for services *448performed and moneys expended by the latter for the formen The balance was made up of many different items extending from January 9, 1890, to and including November 7, 1893. The action was commenced November 6, 1899.

The only questions upon this appeal arise upon the defense of the Statute of Limitations interposed by defendant. The learned referee reached the conclusion that all of the services and expenditures were rendered and made under a…
