Appeal by the plaintiff, Charles H. Slianley, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Westchester on the 22d day of May, 1897, upon the. decision of the court rendered after a trial at the Westchester Special Term dismissing the complaint upon the merits.

Goodrich, P. J.:

The action was brought against Jane E. Shanley to compel her to convey to the plaintiff a certain lot, described in the complaint, under an agreement made between her and Michael, her husband, at the time the latter was executing his will. After the death of the testator the widow died, and the action was revived against the present defendant.

The lot in question was deeded to the wife in 1879, and the complaint alleged that Michael purchased and paid the consideration therefor, but took the title in his wife’s name. The answer controverted this allegation, and at the trial…
