Tbis is an appeal on tbe judgment roll from a judgment based upon a jury verdict in favor of tbe plaintiff for $20,000 damages. Tbis action was originally commenced by tbe plaintiff against defendants, Robert L. Floyd, Dr. Jobn S. Floyd and Dr. George

C. Floyd. Before tbe commencement of tbe trial, tbe plaintiff dismissed as to tbe latter two named defendants.
