Error to tbe Circuit Court of tbe United. States for tbe Western District of Michigan. Tbis was an action brought by tbe Cambria Iron Company against tbe township of Lincoln, a body corporate and politic; in tbe county of Berrien, created under tbe laws of Michigan. Judgment was rendered for tbe plaintiff, and tbe township sued out tbis writ of error. Tbe facts are fully stated in tbe opinion of tbe court,

Tbe principal question raised in tbis case by the assignment of errors is as to tbe sufficiency of tbe first and second counts of tbe declaration. These counts are upon certain bonds alleged to have been made and executed by tbe township of Lincoln,' in tbe county of Berrien, aud State of Michigan, in aid of a railroad company; and the objection made to them is that they do not aver that an election was held to authorize the issue of the bonds, as required by law, and do not aver various other prerequisites to such issue.
