This matter is before the Court on a motion by Defendant, Bard Medical, A Division of C.R. Bard, Inc. ("Bard Medical"), for summary judgment pursuant to Fed. R. Civ. P. 56. [DN 57]. Defendant also *796requests an oral argument on this matter. Fully briefed, this matter is ripe for decision.
