I. FACTS

The essential facts of this case are set forth by the Court of Appeals in People v Stoudemire, 140 Mich App 687, 688; 365 NW2d 214 (1985).

Defendant was originally charged with assaulting a prison guard, MCL 750.197c; MSA 28.394(3), and as a[n] habitual offender-fourth offense, MCL 769.12; MSA 28.1084.
