Mark Kutnyak (Kutnyak) petitions for review of the December 6, 2006, order of the Board of Claims (Board), which, on remand from this court, entered judgment against Kutnyak and in favor of the De*1249partment of Corrections (Department). We affirm.
In Kutnyak v.
