PHILLIPS, District Judge.
William T. Barnett (hereinafter called plaintiff) brought this action against the Des Moines Electric Company (hereinafter called defendant) to recover damages for personal injuries.
The plaintiff was a resident of 1829 Mondamin avenue, Des Moines, Iowa. On August 11, 1923, at about 7:30 o’clock p. m., the electric lights in plaintiff’s house went out, while he was eating his evening meal.
