Plaintiff, Harold Meyer, sued in the circuit court of Cook County, seeking to recover damages for a knee injury he sustained while employed as a millwright for third-party defendant Engineered Structural Products, Inc. (ESP). The injury occurred when a bundle of steel storage racks, which was sitting on the ground, fell over and struck plaintiff. Plaintiff alleged a violation of the Structural Work Act (Ill. Rev. Stat. 1987, ch. 48, par. 60 et seq.) and named as defendants Caterpillar Tractor Company (Caterpillar) and Frazier Manufacturing Corporation (Frazier). Defendants, in turn, sued ESP,…
