This Court convened a special panel pursuant to MCR 7.215(J) in order to resolve the conflict between the previous opinion issued in this case1 and Tyra v Organ Procurement Agency of Mich, 302 Mich App 208; 840 NW2d 730 (2013). The conflict concerns whether our Supreme Court’s opinion in Driver v Naini, 490 Mich 239; 802 NW2d 311 (2011), effectively overruled this Court’s opinion in Zwiers v Growney, 286 Mich App 38; 778 NW2d 81 (2009), despite no express mention of Zwiers.
