Plaintiffs are twenty-two urban hospitals seeking additional reimbursement from the Secretary of Health and Human Services (“defendant” or the “Secretary”) for inpatient services plaintiffs provided to Medicare beneficiaries during fiscal years (“FY”) 2000 and 2001. 2 The parties filed cross motions for summary judgment, which this Court referred to a magistrate judge for a Report and Recommendation.
