WADDILL, Circuit Judge.

This is an appeal and cross-appeal in admiralty from a decree of the United States District Court, for the District of Maryland, rendered on the 14th day of December, 1921. The parties will be referred to by their titles in the lower court, viz. libelant and respondent. The facts in the case are briefly these: On the 20th of March, 1921, the respondent gave the libelant the refusal of cargo space on the steamship Manhattan from Baltimore to Hamburg for 10,000 quarters of heavy grain.
