— On December 16, 1911, Patrick R. Corbett and others filed with the board of commissioners of Clinton county a petition asking for the improvement of a certain highway in said county. Such further proceedings were had before the board of commissioners as resulted in the letting to appellant of a contract, for the construction of the proposed improvement in accordance with plans and specifications filed with the report of the engineer and viewers to whom the matter was referred.
