Speaking generally, it may be said that this action *285was one by the plaintiff Orval C. Jones, to have a deed given by him to his mother, Laura Jones, declared to be a mortgage, and to bar Laura Jones and her husband, Charles W. Jones, from any interest in the real estate conveyed. Charles W. Jones died after a trial was had and before any judgment was rendered and the cause was dismissed as to him.
