The record in this case shows that on and prior to the 3rd day of June, 1943, there was a vacancy in the office of additional circuit Judge in and for the Eleventh Judicial Circuit of Florida by reason of the resignation of Hon. Worth W. Trammell; that on the 3rd day of June, 1943, the Legislature was in regular session at Tallahassee, Florida and on that day the then Governor of Florida presented the name of Marshal C.
