I. It is apparent from the foregoing statement that the invalidity of the municipal election held in the city of Jacksonville on the 18th day of July, 1893, is dependent upon the constitutionality of the act of the Legislature under which it was held. Where usurpation of a public office, or franchise, is alleged by the State, and an information in the nature of a quo war-ranto is filed by the Attorney-General to test the right to hold such office, or enjoy such franchise, it is only necessary ordinarily to allege generally, that the person holding the office,…
