This appeal is taken from an order of the District Court for the District of Nebraska, Judge Schatz, denying, after hearing, appellant’s third petition for writ of habeas corpus. We affirm.
The case grows out of the murder of an Omaha cab driver in 1961. He had been beaten with a hammer, then robbed and shot. The petitioner and a codefendant, Curtis Rowland, were tried jointly in a Nebraska state court for murder in the first degree while in the perpetration of a robbery.
