HAWKINS, Judge.
Conviction is for murder, punishment being assessed at confinement in the penitentiary for a term of fifty years.
The prosecution grew out of the killing of J. T. Davis. Deceased was plowing in his field at the time of the killing, which occurred on Monday morning. Appellant fired two loads of buckshot into his body from a single-barrel shotgun. Deceased lived on a rented farm. Appellant had been working for him several months, living on the same farm with his wife and child some two or three hundred yards from the house occupied ' by the deceased and his family.
