The plaintiff in error was indicted for a violation of section 65S of the Penal Code of 1895, which is in the following language; “If any person, by false representation of his own respectability, wealth, or mercantile correspondence and con*450nections, shall obtain a credit, and thereby defraud any person of any money, or other valuable thing,” etc., “he shall be deemed a cheat and swindler.” His motion for a new trial, based on the general grounds alone, was overruled, and he brings error.
