MEMORANDUM AND ORDER

FRIEDMAN, District Judge.

This matter is before the Court on the City of Norfolk’s and the Norfolk City School Board’s (hereinafter collectively the defendants) motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. A hearing was held on January 29, 1999, at which time the Court took the defendants’ motion under advisement.
