This is the second appeal of this case. The first one is reported in 207 Ky. 813, 270 S. W. 58. In that opinion the facts ont of which the litigation grew are stated, and will not be repeated in this one. The first opinion settled the rights of the parties upon the record as then presented, as well as adjudged their rights arising from the facts that might be developed under the various contentions made, and.reversed the judgment in favor of plaintiff, rendered by the trial court.
