MEMORANDUM OPINION

DOUGLAS O. TICE, Jr., Bankruptcy Judge.

This adversary proceeding raises the issue of whether the creditor plaintiffs’ construe tive trust claims may be allowed in these consolidated bankruptcy eases against the funds in a bank account of the debtors. The facts are undisputed, and the issue comes before the court for decision on the parties’ cross-motions for summary judgment.

For the reasons stated in this memorandum opinion, the court will grant the plaintiffs’ motion for summary judgment and will deny the Trustee’s motion for summary judgment.
