I. INTRODUCTION

The Court has previously entered its order confirming a plan of reorganization for the Debtors in these procedurally consolidated proceedings. Pursuant to that plan, David Beckman, the plaintiff in the adversary proceeding now before the Court (“Beckman” or “Plaintiff’), assumed the office of the liquidating trustee whose role is to marshal and liquidate the assets of these estates.
