MEMORANDUM AND ORDER

PETTINE, Senior District Judge.

This is an action alleging employment discrimination based on race, color, and national origin. The defendants have made a motion, pursuant to Fed.R.Civ.P. 12(b)(6), to dismiss the plaintiffs claims that are based on her 1989 termination. The defendants argued that, under the doctrine of res judicata, a prior stipulated arbitration award barred the plaintiffs current federal civil rights claims relating to that termination.
