The respondent and appellant were rival candidates for the office of sheriff of .Eureka county, at the general election held therein, on the 3d day of November, 1896; the canvass of the returns of the various election precincts made by the board of county commissioners of said county on the 10th day of November, 1896, gave the respondent 164 votes, and the appellant 168 votes, and an order was thereupon made by said board declaring the appellant duly elected to the said office, and a certificate of election was issued to him as such.
