BENEDICT, District Judge.
This is a proceeding in rem to enforce a lien upon the bark J. F. Spencer for the amount of certain advances made by the libellants on the request of the master, to supply the necessities of that vessel. [Case No. 7,315.]
The ease now comes up in the form of exceptions to the commissioner’s report; but it must be considered to be on hearing upon the questions of law and of fact, which were not disposed of at the first hearing, and is to be decided upon the evidence reported by the commissioner in addition to that taken in court.
