This is a common-law action for damages for personal injuries sustained by the 'plaintiff, Bud Copeland, while employed at a sawmill in Wayne county, it being averred that the defendants had not complied with the Workmen’s Compensation Law (Code 1932, section 6851 et seq.). The action was brought by him against Pierce Cherry, who was operating the sawmill; and against the Manassa Timber Company, the owner of the timber being sawed, on the theory that Pierce Cherry was operating the mill as the agent or servant of the timber company; and against J.
