— In an action to recover damages for wrongful déath, the defendants appeal from an order of the Supreme Court, Kings County (Hutcherson, J.), dated April 29, 1987, which denied their motion to dismiss the complaint for failure to state a cause of action, or alternatively, for summary judgment.

Ordered that the order is modified, on the law, by deleting the provision thereof which denied that branch of the defendants’ motion which was for summary judgment dismissing the complaint, and substituting therefor a provision granting that branch of the motion; as so modified the order is affirmed,…
